Selling Car Same Year As Purchased

Let's say I'm banking on the Pickens Prop. to pass in California, and I want to sell my brand new 2008 before the market drops because of the new $10000 rebate.

Can I still claim my Tax Credit for year 2008, if the car is no longer in my possession when I file in 2009?
